Today, the I. Senate for Criminal Matters of the Oberlandesgericht for the State of Schleswig-Holstein denied the Prosecutor General’s application to lift the stay of the execution of the extradition arrest warrant against Carles Puigdemont.
Based on the current facts of the proceeding, the Oberlandesgericht does not see an increased risk of flight for Carles Puigdemont, so that he remains free. The court’s order of April 5, 2018, according to which the extradition arrest warrant’s execution against Carles Puigdemont has been stayed under conditions (among others, the obligation to report, on a weekly basis, to the police), remains in force.
The Prosecutor General based its application to lift the stay of the extradition arrest warrant’s execution on new information from Spain according to which, argued the Prosecutor General, there was an increased risk of flight. Based on the information submitted, the I. Senate for Criminal Matters of the Oberlandesgericht did not see an increased risk of flight.
It is still open when a final decision by the I. Senate for Criminal Matters on the extradition’s admissibility is to be expected. The Prosecutor General has not yet submitted an application to determine the admissibility of Puigdemont’s extradition.
