Administrative Court and Administrative Court of Appeals of the State of Schleswig-Holstein
The Administrative Court and the Administrative Court of Appeals, with offices in Schleswig, are responsible for adjudicating on disputes relating to public law. Both courts serve the protection of the individual against illegal actions by the administration. Consequently, cases regarding status of foreigners and political asylum, the promotion of vocational training, school and university qualification, revenue law, planning and building laws and regulations, civil service law, regulatory law, and health care law, as well as air pollution prevention and administrative regulations of trade are all handled.
Normally, the Administrative Court is the first-instance court for all administrative disputes in the State of Schleswig-Holstein. It is not required, to to be represented by a lawyer. Fees depending on the amount in dispute have to be paid, on account, after the filing of a claim. The court makes its decisions through a panel of three professional judges. If oral evidence is to be taken, two honorary judges (jurors) are added. However, the majority of the cases are assigned to a judge sitting alone.
The Administrative Court of Appeals is responsible for complaints against and appeals from decisions of the Administrative Court. It also takes decisions at first instance regarding disputes that concern certain large-scale projects (such as under the provisions of the Atomic Act, and such matters as power stations, airports, large refuse incineration plants, large-scale planning approval procedures, etc.).
The courts do not give legal advice; however, if requested, and on payment of appropriate expenses, they will make decisions on questions referred to them. Applications or pleadings must be submitted by sending them through the post or by fax
