Overview of duties and responsibilities
The Higher Regional Court in Schleswig is the appellate court in civil, family and criminal matters for the Land of Schleswig-Holstein.
Its courts are responsible for:
- appeals and complaints against judgments and decisions of the district courts, in civil proceedings, including disputes between citizens or companies over money, delivery of property and defaults, and
- appeals against decisions of the local courts, in family and child matters (divorce, maintenance, custody).
The Higher Regional Court is a court of appeal in criminal matters and administrative offences, and is also responsible for decisions over the length of time that individuals are remanded in custody. Furthermore, it can be the first instance court for prosecutions relating to protection of the Land in terrorist matters, brought by the Federal Prosecutor’s Office.
In addition to its judicial function, the Higher Regional Court performs numerous administrative duties.
With its judicial and non judicial trainees and its team of civil servants and clerks, the administrative department of the Higher Regional Court’s responsibilities include the administration of ordinary court staff in Schleswig-Holstein, the continuing education of judges, notary matters and certificates of entitlement to marry (recognition of foreign divorces). Other aspects of administration are the examination’s office for law students taking the first bar exam, and the department for trainee lawyers.
