Landgericht Lübeck (Lübeck District Court)

The Lübeck District Court is a first-instance forum for substantial criminal matters as well as those civil proceedings concerning property disputes where the amount in dispute exceeds €5,000, and for official liability claims.

The Lübeck District Court has jurisdiction as an appellate court and is competent to review court (appeals, complaints) against decisions of the Lübeck Local Court, as well as the local courts in the District - Ahrensburg, Reinbek, Bad Oldesloe, Schwarzenbek, Bad Schwartau, Mölln, Ratzeburg, Oldenburg in Holstein, and Eutin.

The local courts have jurisdiction over civil court matters where the amount disputed is €5,000 or less, criminal matters, administrative offence proceedings, family law cases, cases regarding rental property, probate matters, insolvency proceedings, execution proceedings, and custodial matters. There are also some special jurisdictions. Moreover, the local courts have jurisdiction over tenancy disputes with regard to living space, irrespective of the amount in dispute.

Additional details about the jurisdiction of local courts and of the District Court are regulated in §§ 23 ff. and 71 ff., Gerichtsverfassungsgesetz (GVG), (Judicature Act) and the supplemental law of the state. For example: the Schleswig Local Court has jurisdiction for the issue of default summonses in its role as the Central Summary Court (Magistrate’s Court in England) of the State of Schleswig-Holstein.

Lübeck Local Court does not fall under the jurisdiction of the Lübeck District Court, but has its own district in its capacity as Administrative Court for the City of Lübeck.
