Jurisdiction
The Kiel District Court is a first-instance forum for civil proceedings (for example, disputes between individuals or companies with regard to claims for money, claims for restitution or injunctive relief) where the amount in dispute exceeds €5,000, with the exception of family law cases and cases regarding rental matters. The Kiel District Court has jurisdiction over disputes arising in the districts of Segeberg, Plön, and Rendsburg-Eckernförde, as well as the cities of Kiel and Neumünster.
In addition, the District Court hears complaints and appeals in civil proceedings against decisions of the local courts within its jurisdiction (with the exception of judgments of the local courts with regard to family law cases).
In principle, the District Court is a first-instance forum for criminal proceedings, if, at the commencement of the prosecution, the likely punishment is a term of imprisonment of more than four years. In addition, the District Court hears complaints or appeals against decisions of the local courts with regard to criminal matters.
The Court
Decisions are made through panels of judges in the District Court.
Civil courts have jurisdiction with regard to matters of civil law. Special courts are responsible for cases concerning medical liability, construction disputes, solicitor’s or notary’s liability cases and disputes in the communications and information technology sectors.
Higher and lower criminal courts have jurisdiction with regard to criminal matters
Mandatory representation by a lawyer
Without exception, only admitted lawyers have the right of audience (all parties must be represented by a lawyer) in the District Court. The lawyer is the contact person for the Court as well as for the party in a lawsuit.
